These Terms of Service ("Terms") are a legal agreement between you and SpottID LLC ("SpottID," "we," "us," or "our") governing your use of the SpottID mobile application and our websites at getspottid.com (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
SpottID is a proximity-based platform for car culture. People who notice cars ("SpottIRs") can discover beacon-enabled vehicles nearby, photograph them, and submit those photos to the vehicle owner, who decides whether to add them to their gallery and the community feed.
Eligibility
You must be at least 13 years old to use the Services. By using SpottID, you represent that you are 13 or older and that you are able to enter into these Terms. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian.
Your account
You are responsible for the information you provide, for keeping your login credentials secure, and for activity that occurs under your account. Provide accurate information and keep it current. Notify us promptly if you believe your account has been used without your permission.
Acceptable use and content rules
We have zero tolerance for objectionable content and abusive behavior. By using the Services, you agree that you will not submit, post, or share content, or behave in a way, that:
- Is unlawful, harassing, threatening, abusive, hateful, defamatory, or invasive of another person's privacy.
- Is sexually explicit, obscene, or otherwise objectionable.
- Depicts or encourages violence, self-harm, or illegal activity.
- Infringes the intellectual property, privacy, or other rights of any person.
- Is used to track, stalk, identify, or harm another person.
- Is spam, fraudulent, or intended to deceive.
You also agree not to misuse the Services, including by interfering with their operation, attempting unauthorized access, scraping data, or using the Services to collect information about people without their consent.
We may remove content and suspend or terminate accounts that violate these rules. We act on reports of objectionable content promptly, and within 24 hours where required, by removing the content and removing the user who provided it when appropriate.
Reporting and blocking
If you see content that violates these Terms, you can report it through the Services. You can also block other users. We review reports and take action at our discretion, which may include removing content, restricting features, or terminating accounts.
User content and photo license
"User content" means the photos, captions, and other material you submit to the Services. The Services share photos as lower-resolution versions intended for in-app display and social sharing. The original high-resolution photo files remain the property of the SpottIR who created them. SpottID does not take ownership of your original files.
License you grant to SpottID
By submitting a photo, you grant SpottID a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, display, and distribute the lower-resolution version of that photo within the Services and to use it to operate, promote, and market the Services. You represent that you created the photo or otherwise have the rights needed to submit it and to grant this license.
License granted to the vehicle owner
When a vehicle owner approves a photo of their vehicle, that owner may use the lower-resolution approved photo for their own personal and promotional purposes. This license applies only to the lower-resolution shared version, not to the SpottIR's original high-resolution file.
Responsibility for your content
You are responsible for the content you submit. Do not submit content you do not have the right to share. We do not claim ownership of your content beyond the licenses described above, and we may remove content at our discretion.
Owner review
Photos submitted by a SpottIR are sent to the vehicle owner for review and are not public by default. The owner may approve, reject, or report a submission. Only approved content appears in an owner's gallery, and only content shared to the feed appears in the community feed.
Beacons and subscriptions
SpottID beacons and subscriptions are sold through our website and managed by our commerce partner. Subscriptions are billed on the terms shown at the time of purchase. All sales are final and we do not provide refunds except as required by law. Beacon hardware becomes your property upon delivery. You are responsible for using beacons in compliance with applicable law.
Termination
You may stop using the Services at any time, and you may delete your account from within the app. We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. Sections of these Terms that by their nature should survive termination will survive, including content licenses you have granted, disclaimers, limitations of liability, and dispute resolution.
Disclaimers
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that beacon detection will work in all conditions. You use the Services at your own risk.
Limitation of liability
To the fullest extent permitted by law, SpottID and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.
Indemnification
You agree to indemnify and hold harmless SpottID and its owners, employees, and partners from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Services, your content, or your violation of these Terms or the rights of any third party.
Dispute resolution and arbitration
Please read this section carefully. It affects how disputes between you and SpottID are resolved and limits the ways you can seek relief.
You and SpottID agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be administered by a recognized arbitration provider under its applicable rules, and will take place in Ohio or another mutually agreed location, or by remote means where available.
Class action waiver. You and SpottID agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a class or representative proceeding.
If this entire dispute resolution section is found unenforceable, then the parties agree that any dispute will be resolved in the state or federal courts located in Ohio.
Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules. Subject to the dispute resolution section above, you agree to the exclusive jurisdiction of the state and federal courts located in Ohio for any matter not subject to arbitration.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
